“路怒”嫌犯涉“一級(jí)謀殺罪”

美國(guó)亞利桑那州坦佩市警方17日說(shuō)，一名19歲的中國(guó)女留學(xué)生當(dāng)?shù)貢r(shí)間16日下午駕車(chē)時(shí)遭槍殺，當(dāng)?shù)鼐揭呀?jīng)逮捕了涉嫌開(kāi)槍的32歲女子霍莉•戴維斯。有律師介紹稱(chēng)，如果戴維斯“一級(jí)謀殺罪”的指控成立，她可能面臨終身監(jiān)禁甚至死刑。

19歲的中國(guó)留學(xué)生江玥中槍后身亡。32歲的嫌犯霍莉•戴維斯被控一級(jí)謀殺罪。

16日下午，受害人江玥駕駛汽車(chē)，在交叉路口等紅燈時(shí)被后車(chē)追尾(be involved in a collision at an intersection)。江玥車(chē)上一名男性友人下車(chē)檢查車(chē)輛損壞情況(assess the damage)，發(fā)現(xiàn)肇事車(chē)女司機(jī)竟持槍走下車(chē)來(lái)。肇事者來(lái)到車(chē)前，向江玥連開(kāi)數(shù)槍(fire several shots)。江玥中槍后無(wú)法控制車(chē)輛(lose control of her vehicle)，失控撞上另一輛車(chē)(crash into another car)。隨后嫌犯駕車(chē)逃逸(flee the scene)。

嫌犯戴維斯將被控訴4項(xiàng)重罪：一級(jí)謀殺罪(first-degree premeditated murder)、持致命武器重度攻擊他人罪(aggravated assault with a deadly weapon)、持致命武器行為不當(dāng)罪(disorderly contact with a deadly weapon)以及私藏致命武器罪(prohibited possession)。

這起案件被美國(guó)媒體稱(chēng)為“路怒槍擊”，但警方調(diào)查顯示，戴維斯可能醉酒或?yàn)E用藥物，且存在精神疾病和暴力傾向，事因并非簡(jiǎn)單的“路怒”(road rage)。

在美國(guó)刑法中，一級(jí)謀殺罪(first-degree murder)是指非法施行殺人行為且兼具“殺人之意圖”及“事先預(yù)謀計(jì)劃”者。二級(jí)謀殺罪(second-degree murder)是指有殺人的故意而其殺人行為并非經(jīng)預(yù)謀或計(jì)劃，且非出于義憤者。
