《電影產(chǎn)業(yè)促進(jìn)法》明年實(shí)施

11月7日上午，全國(guó)人大常委會(huì)第二十四次會(huì)議以146票贊成、1票反對(duì)、8票棄權(quán)，表決通過(guò)《電影產(chǎn)業(yè)促進(jìn)法》。作為我國(guó)文化產(chǎn)業(yè)領(lǐng)域的第一部法律，該法將于明年3月1日起開(kāi)始實(shí)施。

The top legislature on Monday adopted a law on the film industry, promising harsh punishment for firms that fabricate box office earnings, data or information.

全國(guó)人大常委會(huì)周一(11月7日)通過(guò)了電影產(chǎn)業(yè)相關(guān)法律，承諾對(duì)票房收入、數(shù)據(jù)或信息造假的公司進(jìn)行嚴(yán)懲。

Film distributors and theaters will have all their illegal earnings confiscated and be fined upward of 500,000 yuan (about 73,800 U.S. dollars) if they falsify ticket sales data, according to the law.

該法規(guī)定，如果電影發(fā)行方和影院對(duì)票房數(shù)據(jù)造假，將沒(méi)收其全部違法所得，并處以50萬(wàn)元以內(nèi)的罰款。

If their illegal earnings exceed 500,000 yuan, the fine will be up to five times their illegitimate earnings.

如果違法所得超過(guò)50萬(wàn)元，則處以違法所得5倍以內(nèi)的罰款。

此次通過(guò)的《電影產(chǎn)業(yè)促進(jìn)法》減少了審批項(xiàng)目(reduce number of items for approval)、降低了準(zhǔn)入門檻(lower the threshold to the film industry)，取消了電影制片單位審批、攝制電影片(單片)許可證審批等行政審批的項(xiàng)目。

我們一起來(lái)看看《電影產(chǎn)業(yè)促進(jìn)法》中的突出亮點(diǎn)：

1. 未經(jīng)權(quán)利人許可，任何人不得對(duì)正在放映的電影進(jìn)行錄音錄像(sound or video recording of the film without authorization is prohibited)。發(fā)現(xiàn)進(jìn)行錄音錄像的，電影院工作人員有權(quán)予以制止，并要求其刪除;對(duì)拒不聽(tīng)從的，有權(quán)要求其離場(chǎng)。

2. 電影發(fā)行企業(yè)、電影院等應(yīng)當(dāng)如實(shí)統(tǒng)計(jì)電影銷售收入，提供真實(shí)準(zhǔn)確的統(tǒng)計(jì)數(shù)據(jù)(Film distributors and theaters should provide authentic and accurate ticket sales data)，不得采取制造虛假交易、虛報(bào)瞞報(bào)銷售收入等不正當(dāng)手段，欺騙、誤導(dǎo)觀眾，擾亂電影市場(chǎng)秩序。

3. 攝制電影的法人、其他組織應(yīng)當(dāng)將取得的電影公映許可證標(biāo)識(shí)置于電影的片頭處;電影放映可能引起未成年人等觀眾身體或者心理不適的，應(yīng)當(dāng)予以提示(There should be warning prior to the film if the content may cause physical or psychological disconfort among minors)。

4. 演員、導(dǎo)演等電影從業(yè)人員應(yīng)當(dāng)堅(jiān)持德藝雙馨，遵守法律法規(guī)，尊重社會(huì)公德，恪守職業(yè)道德，加強(qiáng)自律，樹(shù)立良好社會(huì)形象(Personnel in the film industry should pursue both professional excellence and moral integrity, abiding by laws and regulations and building good public images)。
